Slips, Trips & Falls - Public Liability
Slips, trips and falls are usually harmless or only result in minor injuries, but a particularly serious incident can be far more dangerous.
Fortunately, compensation may be available to them for people injured in such accidents though many people are unaware of it.
What is a public liability claim?
A public liability claim enables you to pursue compensation for injuries that you may sustain due to someone else’s negligence.
You need to be able to prove that your injuries were caused by an ‘at fault’ party.
The most common type of public liability claims include:
- Slips, trips or falls in public places,
- Accidents in rental properties,
- Accidents in private buildings,
- Accidents in amusement or leisure venues,
- Accidents on a plane or a boat,
- Accidents sustained on council owned property,
- Injuries cause by animals (such as a dog attack),
- Injuries sustained whilst working under a labour-hire or host employment agreements.
The above is not a comprehensive list though if you believe you have a public liability claim, we invite you to contact our local claims team to discuss your rights.
What should you do if you have had a public liability accident?
- Notify the owner / managers of the accident site and complete a written incident form (if applicable).
- Take photographs of the accident site.
- Take photographs of your injuries.
- Attend your GP or local hospital, despite how minor your injuries may seem, reporting how and where you were injured.
- Keep receipts for your out of pocket medical, pharmaceutical, and or rehabilitative expenses
What can you claim for?
Some of the things that you may also be able to claim for are:
- Lost wages & lost superannuation,
- Medical, rehabilitation and or pharmaceutical expenses,
- Care and assistance.
Are there time limits for claims?
There are strict time limits which apply to public liability claims in Queensland.
